QC court dismisses Angel Locsin's case vs manager

The Quezon City Regional Trial Court on Friday dismissed the civil case filed by actress Angel Locsin against her manager due to lack of interest.

In a one-page order, QCRTC Branch 81 Presiding Judge Ma. Theresa Yadao dismissed the petition for reformation of instrument and/or recission/breach of contract and damages filed against Rebecca “Becky" Aguilar after granting the motion to dismiss filed by Locsin.

Locsin sued her manager sometime in December, 2006 when

he asked the court to order the reformation of the terms of the Artist Management Contract which she had signed, to reflect the true intention of the parties.

She also wanted the contract to have a period of only two years, which meant that it would end on December 28, 2006.

In the same petition, the actress also sought the court's affirmation of the repudiation she made regarding the Nov. 27, 2006 Artist Management Contract, alleging that Aguila committed a serious breach of her obligations.

In the same petition, Locsin also asked the court to order the defendant for the reimbursement of all the litigation costs and expenses in the amount of P500,000.

But before the court rule on the case or even issue subpoena for Aguila, Locsin and her manager patched up their differences.

“The motion to dismiss filed by plaintiff proved to be proper and in order and pursuant to Section 1, Rule 17 of the 1997 Rules of Procedure. The instant case is dismissed," Judge Yadao ruled Friday.

It meant that a complaint may be dismissed by the plaintiff by filing a notice of dismissal at any time before service of the answer or of notice for summary judgment.

Locsin, whose real name is Angelica Colmenares filed the motion to dismiss the case on May 22, 2007, a few months after she and Aguila settled their spat.

In her motion to dismiss, Locsin claimed that when she filed the case in December, 2006, she was under misapprehension of facts involving her manager which led her to file the case.

“After having been fully apprised of certain circumstances, I have come to realize that the filing of the case was a mistake and a product of a misunderstanding between me and the defendant. Because of this, I am no longer interested in proceeding with the instant case and to save the time of court," Locsin added in her motion to dismiss. - GMANews.TV
